According to the medical examiner's report, the dead man, identified as BM, had been drinking alcohol and was intoxicated when he died from a brain haemorrhage.
His brother, PM, gave evidence that they were together on the night of Nov 18 in the common living area of the Satwa villa, which was occupied by six men working for the same company. One of the accused, identified as BK, 25, approached them at 3am and took offence when BM made a reference to Kenya's Masai tribe and called him "Masai".</p>
<p>PM said BK asked them not to call him "Masai" and then went to his room and returned with the other three accused.
"A tall, large man hit me from behind and I fell to the ground. I saw the four of them punch my brother and when he fell to the ground, they kicked him in various parts of his body," PM said in testimony to the public prosecution.
He said the four men dragged him and his brother to their room and dumped them on the floor. When he woke at daybreak, his brother was lying beside him with blood coming out of his nose and mouth. When an ambulance arrived an hour later, he learned that he was dead.</p>
<p>The defendant BK contradicted PM in his testimony to the public prosecutor.
He said PM and BM assaulted him in the common living area and he ran to his room, where his three friends asked what had happened. When they went back together, BM struck the first blow, hitting another defendant, JK, 26, on the head with a bottle, he said.
This enraged JK, who grabbed a plastic chair from BM and hit him with it over the head until he fell. JK continued to kick BM all over his body and head, BK added. He said PM, meanwhile, used a clothes hanger to hit the defendant JN, 25, who grabbed it and hit him back.</p>
<p>BK said they then carried the beaten brothers to their room, while another defendant, RM, 26, cleaned up blood traces from the brawl.
