Lawyer claims nurse falsified time of death in DNR case
DUBAI // The lawyer for an Indian doctor accused of murdering a patient by following an order not to resuscitate has claimed a nurse forged the time of death in a report.
MA's lawyer yesterday told the Criminal Court of First Instance the nurse attending to Ghulan Mohammed added 30 minutes to the time, making the death appear to be MA's responsibility. "We have a report from Rashid Hospital to prove the forgery, Your Honour," she told Judge Maher Salameh.
The court refused to take defence documents for the Austrian doctor EA, who is alleged to have made the order not to resuscitate Mr Mohammed, because he was absent due to the death of his wife. But it said EA's lawyer could pass her arguments to the prosecution before the court issued a verdict on March 18.
EA, the former chief of intensive care at Rashid Hospital, and MA have been charged with the premeditated murder of Mr Mohammed, who died on February 19, 2009.
Prosecutors claim that two days after issuing a non-resuscitation order, EA shut down the patient's life-support equipment and increased his morphine dose, prompting a fatal heart attack.
