Facebook defamation sentence over posting of wife's picture revoked

Man convicted of posting picture of his estranged wife brought court letter from her forgiving him.

DUBAI // A technician who confessed to posting a defamatory picture of his estranged wife with another man on Facebook saw his sentence reduced this morning after producing a waiver from her.

The 41-year-old FR, from India, was sentenced in absentia to a month in prison on May 23 and fined Dh1,000 for being drunk at the time of his arrest without possessing an alcohol licence.

But the Dubai Misdemeanours Court revoked the prison sentence after FR presented an authenticated waiver from his wife. The fine was upheld.

Prosecutors said that at dawn on February 4, the 37-year-old FC, also Indian, received an SMS from her husband. The two lived in different homes after separating four years ago.

The SMS said he had posted FC's picture on Facebook.

She said she found a picture of her with a relative and the caption: "A mother of 2 kids (37 years) with her 24 years ......... kicking her hubby out of the house, good move ...... cute couple......"

FR said during investigations that his wife had left him in July 2010 she met the man in the picture, identified in records as PD. He said he did not know the nature of their relationship, and when he asked, she told him it was her brother.

FR was arrested on the evening of February 15, drunk after consuming three glasses of Scotch, records show.

FC told prosecutors that the man in the picture was her cousin, and that the photo was from a family album.
